Lawsuit Targeted at Disneyland Regarding Magic Key Annual Passes
A class-action lawsuit has been filed targeting Disneyland and the sales of the new Magic Key annual passes. Jenale Nielsen of Santa Clara County calls herself a longtime Disney customer, was under the impression that when she purchased her $1399 annual pass, that there would be no blockout dates. Instead, she said some dates were blocked out to her but were available to daily ticket buyers.

Nielsen said she discovered this issue when she went to make a reservation for a weekend in November and her dates were blocked out but they were available for daily ticket buyers.
“Ms. Nielsen reasonably believed and relied upon Disney’s advertisement and promise to mean that, if Disney had capacity at its Anaheim parks, Ms. Nielsen and her fellow Dream Key pass holders would be allowed to make reservations and visit the parks,” the lawsuit says.
The Disneyland website says pass buyers are notified that they are not guaranteed access to the park, regardless of the price of their annual pass. “We have been clear about the terms of the Magic Key product and we know that many of our guests are enjoying the experiences these passes provide,” spokeswoman Liz Jaeger said. “We will vigorously defend our position as the case proceeds.”

The lawsuit accuses Disney of breach of contract, negligent misrepresentation, concealment, false advertisement and unfair competition, and seeks damages and attorneys’ fees.

According to the LA Times, the lawsuit was originally filed in November in Orange County Superior Court but was moved to U.S. District Court because the case is a potential class-action lawsuit that involves “a matter of controversy that exceeds the sum or value of $5,000,000,” according to court records. The lawsuit says Disney collected more than $5 million selling the Dream Key.
