Ron DeSantis Asks Judge To Dismiss Disney Lawsuit
The next chapter in the ongoing battle between Ron DeSantis and The Walt Disney Company kicked off today when both sides met in a Tallahassee Court to present their oral arguments.
Disney is suing DeSantis and his allies over the dissolution of the Reedy Creek Improvement District. The special district was replaced by the governor-appointed Central Florida Tourism Oversight District.
According to Disney, DeSantis dissolved Reedy Creek in retaliation for Disney publicly opposing Florida’s Parental Rights in Education Bill (which critics dubbed “Don’t Say Gay”).
DeSantis Moves to Dismiss
On Tuesday, the governor’s attorneys argued that the case should be dismissed. DeSantis, they contend, should be immune from suit since he doesn’t enforce any of the laws that Disney objects to.
Neither DeSantis nor the security of the Florida Department of Economic Opportunity, which was also named in the lawsuit, have the power to enforce the laws that took control of Reedy Creek away from Disney.
The case will be adjudicated by U.S. Judge Allen Winsor, whose ruling could determine who controls the special district.
Winsor was appointed to the bench by President Donald Trump in 2019.
Disney’s Response
In response to DeSantis’s motion to dismiss, Disney has argued that the governor and his appointees are using political institutions to punish opposing viewpoints.
“That premise is not just legally unsupported, it is profoundly un-American,” Disney said in court papers.
While the feud between DeSantis and Disney is showing no signs of slowing down, for now, at least, the ball is in Judge Winsor’s court.
