FuelRod Facing Class Action Lawsuit After Doing Away With ‘Free’ Unlimited Swaps
When FuelRod machines begin surfacing at Walt Disney World a few years ago it was a real game-changer. No longer did theme park guests have to worry about running out of charge on smartphones and tablets. For a one-off fee of $30, guests could purchase a FuelRod starter kit with a battery which would rapidly charge your items. When your FuelRod battery ran out of juice, guests could stop at any FuelRod machine and get a replacement battery for FREE!
Sound too good to be true? Well, this policy is at the heart of a brand new class-action lawsuit that is being filed by a Los Angeles law firm against the company that operates the portable charger swapping machines at Disneyland, Disney World, Universal Studios, SeaWorld and other parks!
The according to the Orange County Register, a class-action suit was filed on October 25th at the U.S. District Court for the Southern District of California in SanDiego against Tricopian Inc and SaveMe Batteries North America. These are the parent companies of FuelRod portable charges. The suit was filed by the L.A. office of Francis Flynn Jr. on behalf of plaintiff Gabriel Veasey of Sarasota, Florida.
Veasey bought a $30 FuelRod portable charger at Disney World that included “free unlimited swaps’ at a kiosk. After agreeing to the terms and purchasing the item, the machines will now start charging $3 for swapping beginning November 1st. The Lawsuit argues that the initial $30 purchase was meant to cover not only the cost of the charger but payments for future swaps.” By now charging for the service, FuelRod is not fulfilling its end of the agreement leading to the breach of contract and false advertising.
