Ron DeSantis Asks Federal Judge To Dismiss Disney Suit
The legal team representing Florida Governor Ron DeSantis and the Central Florida Tourism Oversight district in their federal lawsuit with Disney have filed a motion to dismiss the charges.
Among other legalities, the governor’s team argues that Disney’s claims against the state defendants are barred by sovereign immunity (the 11th Amendment).
Furthermore, the motion argues that Disney’s claims about the Governor of Florida specifically are barred by legislative immunity.
“But first things first. The Court lacks jurisdiction over at least two defendants—the Governor and the Secretary—who are also immune from suit. Although Disney has grabbed headlines by suing the Governor, Disney—like many litigants before it who have challenged Florida’s laws—has no basis for doing so. Neither the Governor nor the Secretary enforce any of the laws at issue, so Disney lacks standing to sue them,” the defense team wrote.
An Ongoing Legal Battle
The Walt Disney Company sued the DeSantis Administration and the Central Florida Tourism Oversight District, over the passage of a Florida state law that dissolved Disney’s Reedy Creek Improvement District.
The special district had given Disney autonomy over its large swath of land in Central Florida.
According to Disney, the governor’s decision to dissolve the district was made in retaliation for the company speaking out against Florida’s Parental Rights in Education Act, commonly referred to by its detractors as the “Don’t Say Gay” law.
For his part, DeSantis has not shied away from the notion that he is battling Disney on ideological grounds.
His latest motion to dismiss, however, argues that Disney’s case should be dismissed on legal grounds.
“The Court should dismiss the amended complaint, or at minimum, dismiss all claims against the State Defendants.”
