Disney Found 40% Liable in Guest Injury Relating to Food Court Incident
According to a recent post on the Courtroom View Network, after a recent hearing in Florida state’s Ninth Circuit, a jury found Disney Parks and Resorts 40% liable for an accident at the Art Animation Food Court – Landscapes of Flavor that the Plaintiff said left her with a rare nerve disorder.
As a result of the findings, the Plaintiff was awarded less than her $60,000 suit against the theme park you can find the filing here: Wilson v. Walt Disney Parks and Resorts U.S. Inc., 2015-CA-003347.
According to the suit, Jessica Wilson claims that she suffered an injury in June of 2013 when a cast member ran over her foot with a food service bussing cart. Wilson aruges that the injury led her to suffer debilitating complex regional pain syndrome (CRPS). This is a rare condition of the nervous system that can result in chronic pain.
As a result of the verdict, Wilson was rewarded less than $24,000 down from the original $59,840 requested. This is down from Wilson’s lawyer’s original request for more than $11 million in damages and $4.4 million to cover future medical expenses.
The Plaintiff’s lawyers told jurors that a food cart pushed by a Cast Member ran overs Wilson’s food as she turned around from a condiment station which has caused longstanding damage. However, the defense challenged Wilson, poking holes in a story that has changed since the initial incident. Originally it was claimed that the cart ran over her foot twice, this was later altered to once. In addition, a CRPS specialist took to the stand to argue that the symptoms Wilson describes in the aftermath of the event are not common symptoms of CRPS.
